NO FCRA USE. This privately operated website is not affiliated with government and is not a consumer reporting agency. Neither the site nor its advertising partners offers a service for any purpose regulated by the Fair Credit Reporting Act, including credit, employment, insurance, or tenant screening.
1. What This Website Is
Wayne County Criminal History is an independent reference site. It does not keep official records, perform authorized background checks, retrieve private records, or file documents.
Its content identifies offices such as the Wayne County court clerks, Sheriff's Department, West Virginia State Police Criminal Identification Bureau, West Virginia Division of Corrections and Rehabilitation, and West Virginia Sex Offender Registry. It may also connect a visitor to an outside search provider.
2. Rules for Using This Site
A user agrees not to:
- Use the service in violation of federal, West Virginia, or local law
- Threaten, stalk, harass, intimidate, or harm another person
- Use any content for a purpose regulated by the FCRA
- Attempt unauthorized entry into any part of the service
- Send bots, scrapers, or other automated collection tools against the pages
- Interfere with availability, speed, security, or another person's access
3. No Harassment, Stalking, or Discrimination
Information reached from these pages may not be used for stalking, threats, harassment, intimidation, vigilantism, or unlawful discrimination. West Virginia Sex Offender Registry information exists for community safety. Misuse against a listed person can violate West Virginia law and the registry's stated terms.
4. We Are Not a Consumer Reporting Agency
The operator does not produce background checks, credit reports, or other consumer reports and is not a consumer reporting agency under the FCRA. A user must not rely on site content or a linked tool to:
- Make an employment decision
- Evaluate a housing or rental application
- Assess credit or insurance eligibility
- Decide eligibility for a license, permit, or public benefit
- Carry out any other FCRA-regulated purpose
Where an official or legally compliant process is required, use the appropriate authorized provider. West Virginia's state fingerprint repository channel is administered by the West Virginia State Police Criminal Identification Bureau through IdentoGO and is subject to legal authorization limits.
5. No Legal Advice
The material is general information, not legal advice. A licensed West Virginia lawyer should address a person's own warrant, charge, case, sentence, record correction, or expungement question.
6. No Warranties
The service and all content are offered “as is.” No warranty promises that:
- Any page is complete, accurate, or current
- Access will always be uninterrupted
- The service will contain no errors or security defects
- An outside search result will be complete or correctly matched
Records can be amended, dismissed, sealed, expunged, corrected, or delayed. Only the originating Wayne County or West Virginia office can authenticate current status.
7. Third-Party Services and Links
External links may lead to court portals, government offices, legal resources, or search companies. The operator does not control those sites, their availability, prices, results, content, or data practices. Their own terms apply after a visitor leaves.
8. Intellectual Property
Unless another owner is identified, the site's text, graphics, logos, and code belong to Wayne County Criminal History or its content partners. Copying, modifying, redistributing, or creating derivative material requires prior written permission.
9. Limits on Our Liability
To the fullest extent West Virginia law allows, the operator is not liable for loss or damage arising from use of the site, reliance on its content, or use of any linked service.
10. Indemnification
A user agrees to defend and hold the operator harmless from claims, demands, actions, expenses, and reasonable legal fees caused by that user's conduct, violation of law, or breach of these terms.
11. Governing Law
West Virginia law governs these terms. A dispute concerning use of the service must be filed in a court with proper jurisdiction in West Virginia.
12. Changes to These Terms
The terms may be revised. A revised version takes effect when posted on this page.
13. Cutting Off Access
Access may be restricted or ended at any time, without prior notice, when the operator determines that action is appropriate.
14. Severability
If a court finds one provision invalid or unenforceable, the remaining provisions continue. The affected language will be limited only as much as needed.
15. Questions
Questions about these terms may be directed through the Contact page.
